'The Hangover Part II'
Warner Bros. will digitally erase the tattoo from Ed Helms' face in the DVD and Blu-ray versions of "The Hangover Part II" if it's unable to resolve the legal dispute over an artist's allegation of copyright infringement.Attorneys for the studio made the disclosure as part of a brief filed prior to a federal court hearing Wednesday in St. Louis on the suit, filed by artist S. Victor Whitmill. Studio filed the brief to support its argument that an expedited trial should not be granted."If the parties are unable to resolve their dispute, Warner Bros. does not intend to make any use of the allegedly infringing tattoo after the film ends its run in theaters because Warner Bros. will digitally alter the film to substitute a different tattoo on Ed Helms's face," the studio said in the filing.The homevideo version of the sequel is due out in December. During Wednesday's court hearing, U.S. District Judge Catherine Perry set a jury trial date for Feb. 21 rather than the expedited August date sought by Whitmill.Perry also scheduled a mediation hearing for June 16.On May 24, the judge rejected an effort to block theatrical release of the sequel, rejecting Whitmill's request for a preliminary injunction in part because the studio stood to lose more than $100 million. But she also said Whitmill "has a strong likelihood of success" of prevailing in his copyright infringement claim, allowing the case to go forward on an expedited schedule.Contact Dave McNary at dave.mcnary@variety.com
